Terms and Conditions
1. About these terms
These Terms and Conditions (“Terms”) govern your access to and use of aesthetiQ, a product operated by Find Why Consulting Pty Ltd (ABN 72 663 024 342), trading as consultation.club (“aesthetiQ”, “we”, “us”, “our”).
By creating an account, subscribing, or using aesthetiQ, you (“the Clinic”, “you”) agree to these Terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.
These Terms are for clinics and their staff who use aesthetiQ. People who complete the quiz on a clinic's website are not party to these Terms; our handling of their information is described in our Privacy Policy.
2. What aesthetiQ is
aesthetiQ is a subscription tool that a clinic embeds on its own website. It presents a concern-led quiz to website visitors, produces a personalised treatment pathway based on the treatments the clinic has configured, and delivers each completed submission to the clinic as a lead. aesthetiQ is a lead and pre-consultation tool. It is not a medical device, does not provide medical advice, and does not make clinical decisions.
3. Your account
You must provide accurate information when registering and keep it up to date. You are responsible for activity under your account and for keeping your login details secure. You must tell us promptly if you believe your account has been compromised.
4. Subscription, fees, and billing
- aesthetiQ is offered on the plans and at the prices shown at sign-up. As at the date of these Terms, Standard is from $99 per month and Premium is from $150 per month, in each case plus GST, with a discount for annual billing. Prices are in Australian dollars and may change on notice.
- GST or other applicable taxes are added where required.
- Fees are billed in advance for the plan and billing cycle you choose, either monthly or annual. Payments are processed by our payment provider, Stripe.
- You can cancel within the first 30 days at no cost. After that, you can cancel at any time, and your access continues until the end of your current paid period, after which your subscription will not renew. We do not provide refunds for cancellation or change of mind, except where the Australian Consumer Law requires.
- If a payment fails or is overdue, we may suspend or limit access until it is resolved.
5. Your responsibilities as a clinic
You are responsible for:
- The treatments, pathways, descriptions, and any pricing you configure in aesthetiQ, and for ensuring they are accurate and appropriate for your clinic.
- Ensuring your use of aesthetiQ, and any content you configure or publish through it, complies with all laws, regulations, and professional and advertising standards that apply to you in your country. Meeting the regulatory and compliance requirements specific to your country is your responsibility, not aesthetiQ's.
- As a condition of using aesthetiQ, you will include a statement in your own privacy policy explaining that the quiz is provided by aesthetiQ and how patient information collected through the quiz is used. If you would like suggested wording for this, please email us at [email protected]. You must also obtain any consent required, and handle patient information lawfully once it is delivered to you.
- Following up with, and providing services to, the patients whose leads you receive. aesthetiQ delivers the lead; the clinical relationship is entirely yours.
6. Privacy and patient information
Our handling of personal information is described in our Privacy Policy. When a patient completes your quiz, we collect their responses, store them, and deliver them to you as a lead. In relation to that patient information, you are responsible for your own handling of it, including having a lawful basis to receive and use it, and for meeting your own privacy obligations to your patients.
7. Intellectual property
We own aesthetiQ and all associated software, design, and content, except for your own brand assets and the content you provide. We grant you a limited, non-exclusive, non-transferable right to use aesthetiQ during your subscription for your own clinic's use. You grant us the right to use your brand assets and configured content only as needed to provide the service to you.
You may not copy, resell, reverse engineer, or attempt to extract the underlying logic of aesthetiQ, or use it to build a competing product.
8. Acceptable use
You must not use aesthetiQ to:
- Break any law or infringe anyone's rights.
- Upload content that is unlawful, misleading, or that you do not have the right to use.
- Interfere with or attempt to gain unauthorised access to the service or its systems.
- Misrepresent the treatments you offer or make claims you are not entitled to make.
We may suspend or remove access if you breach these Terms.
9. Availability and disclaimers
We work to keep aesthetiQ available and reliable, but we do not guarantee it will be uninterrupted or error-free. aesthetiQ is provided “as is” and “as available”. To the extent permitted by law, we exclude implied warranties. Nothing in these Terms excludes rights you have under the Australian Consumer Law or other laws that cannot be excluded.
aesthetiQ does not provide medical, clinical, or professional advice, and the pathways it presents are general information based on the clinic's own configuration, not a diagnosis or a treatment recommendation from us.
10. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential loss, or for loss of profits, revenue, data, or goodwill. Our total liability arising out of or in connection with aesthetiQ is limited to the amount you paid us in the 12 months before the claim. Nothing in this section limits liability that cannot be limited by law.
11. Indemnity
You agree to indemnify us against claims, losses, and costs arising from your use of aesthetiQ in breach of these Terms, your content or configuration, your handling of patient information, or your breach of any law or professional standard that applies to you.
12. Term and termination
These Terms apply while you have an account or use aesthetiQ. You may cancel in accordance with Section 4. We may suspend or terminate your access if you breach these Terms, if required by law, or on reasonable notice. On termination, your right to use aesthetiQ ends. All records associated with your clinic, including patient leads and images, will be deleted within three months, except any records we are required to keep by law (for example, financial records for tax purposes). If you would like a copy of your clinic's leads before they are deleted, you can request one by emailing [email protected].
13. Changes
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and, where appropriate, notify you. Continuing to use aesthetiQ after changes take effect means you accept them.
14. Governing law
These Terms are governed by the laws of Western Australia, Australia, and the courts of Western Australia have jurisdiction. This applies to all clinics, wherever they are located, subject to any rights you have under laws that cannot be excluded.
